PURCHASE CONDITIONS

1. Obligations of clients and users.

The user undertakes to comply with these general conditions, and to comply with the special warnings or instructions for use contained therein or on the website. L is not responsible for the veracity and accuracy of the data filled in by the user and therefore cannot verify their age. Without prejudice to all of the above, the user of the website agrees to:

a) That the information provided in the order fulfillment registration form is true.

b) To keep the information provided updated.

c) Not to use materials or information that were insulting, obscene, xenophobic, that incite violence, discrimination based on sex, ideology, race, religion or any other discrimination prohibited by law; that are in any way against morality or established public order; that affects fundamental rights, and, in general, that is contrary to the legal system.

d) Not to introduce, store or disseminate data, viruses, codes or any device that is likely to damage the website or to the equipment, networks or systems of any user thereof or of any third party.

e) To guard the username and password assigned, assuming any responsibility that may arise from their improper use.

f) Not to carry out advertising or commercial exploitation activities through the website and not to use the contents and information contained therein to send advertising, nor to collect or store personal data of third parties.

g) Not to use keys or identification data other than their own.

h) To enable the delivery of the requested order by providing an appropriate delivery address that allows it to be received within the normal delivery time of the merchandise. In case of breach by the customer of this obligation, TOP NIMBOS S. L, will not have a responsibility for the delay or the impossibility of delivering the order requested by the customer.

2. Shipping costs.

Shipping costs and are included in the price only in the case of the Spanish Peninsula, including Portugal, for these destinations. If the cash on delivery method is chosen, the price will be increased by 2%.

For other destinations, transportation will increase depending on the destination, and only payment by credit card will be accepted.

3. Placing the order.

Once the purchase has been made and in the shortest possible time, always within 24 hours of its formalization (this period may vary if the purchase is made on Friday or Saturday), the Customer Service Department of TOP NIMBOS SL will send you by e-mail a proof of it. If you do not agree with the information contained in said confirmation, you can request the modification of the same or the cancellation of the order.

4. Availability of products.

The selection of products offered on www.topnimbos.com is valid as long as they are visible on the website, and there is available stock. If the merchandise is in stock, the approximate period is 1 to 2 days. If, on the other hand, we do not have stock, the approximate period will be 4 days. To these we must add the delivery times that the transport operators we work with may have. These deadlines are calculated on working days -from Monday to Friday- since TOP NIMBOS S. L does not make expeditions on holidays, Saturdays, or Sundays. The delivery times indicated are approximate. In the event that there is a rupture of stock or punctual unavailability of an item, TOP NIMBOS S. L will contact you to notify you immediately and give you a new delivery time or, if it is not possible to serve said product, proceed to its cancellation. In any case, a delay in delivery with respect to the indicated deadlines will not entitle the customer to demand any compensation.

5. Shipping methods and terms.

The products are sent to the shipping address that you have indicated in the order. In the case of placing an order for several items with different availability, the delivery time will take into account the longest expected delivery. . In exceptional cases, TOP NIMBOS S.Lreserves the right to break down the order, send available items and leave unavailable items pending a second shipment. In this case, the second shipment is made at no additional cost. In the event that the client detects a problem at the time of delivery of his order (damaged packaging, missing or damaged products), he must indicate this in writing on the delivery note of the carrier, and contact our customer service center by telephone at customer (96 6500081) within the first 24 hours after receipt. 6. Payment.

The delivery period of the merchandise will count from the date the bank confirms the payment of said transfer. TOP NIMBOS S. Lreserves the right to reject any order until this condition is met.

7.d. Receive first, pay later with Sequra. Receive it and check your purchase. You have up to 7 days after the shipment to pay.

8. Right of withdrawal.

The maximum term to request the return is stipulated in 7 business days from the receipt of the order. The circumstances that can cause a return are following:

a) Defective product of origin: Once TOP NIMBOS S.L receives the defective product, it will send you another to replace it. In this case, the change will always be made by the same article or reference. Only the first shipment will be billed to you, and TOP NIMBOS S. L will be responsible for the freight corresponding to the return and the new shipment.

b) Product that, by mistake, does not correspond to the order: TOP NIMBOS S.L will bear the costs of collecting the wrong product and delivering the one corresponding to the order placed.

TOP NIMBOS S.L may refuse the return of a product if the product is returned in an obviously deteriorated way due to causes that go beyond the mere verification of the characteristics and good condition of a product.

9. Product warranty.
TOP NIMBOS S.L will make or will not make changes or returns unless:

Our telephone service hours are from 09:00 to 14:00 and from 16:00 to 19:00 from Monday to Friday.

b) The products are in perfect condition.

11. Applicable legislation. Submission to jurisdiction.

In the event that the purchasing party is domiciled outside of Spain, or that it is a sale by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Alcoy (Spain).
